AGREEMENT TO OUR LEGAL TERMS

We are BitterSweet, Inc., doing business as Dreamaker ("Company," "we," "us," "our"). We operate the Dreamaker platform and related services (the "Services").

These Legal Terms constitute a legally binding agreement made between you and BitterSweet, Inc., concerning your access to and use of the Services. By accessing the Services, you agree to be bound by all of these Legal Terms.

The Services are intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services.

1. OUR SERVICES

  1. The Company provides AI video synthesis and generation services.
  2. Due to the nature of AI models, the Company does not fully guarantee the quality, accuracy, or integrity of the generated output, and unexpected results may be produced. All generated outputs within the Service are automatically created at the request of the Member. The Company assumes no warranty liability for the generated content.

2. INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in our Services (excluding user-generated content), including source code, databases, website designs, and logos.

By posting Contributions (including Concepts and Example Videos) to any part of the Services, you automatically grant to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide right, and license to host, use, copy, reproduce, display, and distribute such Contributions for any purpose, including promoting and improving the Services.

3. CREDITS, PAYMENTS, AND REFUNDS

  1. Video generation consumes Credits. Credits can be purchased through our payment gateway partners (e.g., Stripe).
  2. Once a video generation request is successfully processed and the AI pipeline is initiated, the consumed Credits are non-refundable.
  3. If video generation is not completed due to system errors of the Company or failure of the AI model, the deducted Credits will be automatically refunded (restored) to the Member's account.
  4. Cash refunds for purchased Credits are processed in accordance with applicable consumer protection laws. Consumed credits are strictly non-refundable.

4. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. You agree not to:

  1. Use another person's photos, videos, or personal information without authorization (infringement of portrait rights and copyrights).
  2. Use Deepfake technology to create and distribute illegal, false video content that causes sexual humiliation or defamation.
  3. Generate or post content that is obscene, violent, hateful, or discriminatory.
  4. Systematically retrieve data to create a database or directory without written permission from us.

5. DISCLAIMER AND LIMITATIONS OF LIABILITY

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES. WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR LIABILITY TO YOU WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US.

6. GOVERNING LAW AND DISPUTE RESOLUTION

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of California. Any dispute will be finally and exclusively resolved by binding arbitration in California, United States.
